서울중앙지방법원 형사합의22부(재판장 조형우)는 22일 정치자금법 위반 혐의로 기소된 오세훈 서울시장에게 벌금 1000만원을 선고했다.
오 시장은 2021년 서울시장 보궐선거를 앞두고 정치브로커 명태균 씨로부터 비공표 여론조사를 제공받고, 해당 비용을 후원자인 김한정 씨가 대신 지급하도록 한 혐의로 재판에 넘겨졌다.
재판부는 오 시장이 명 씨에게 여론조사를 의뢰했고, 김 씨를 통해 여론조사 비용을 대납받은 사실이 인정된다고 판단했다. 또한 해당 비용은 정치자금법상 정치자금에 해당한다고 봤다.
재판부는 “오세훈 시장이 2020년 12월 명태균 씨를 만나 선거 여론조사 전문가를 소개받았고, 명 씨에게 여론조사를 의뢰할 만한 동기가 있었다”며 “오 시장의 의뢰에 따라 비공표 여론조사가 진행됐고, 미래한국이 실시한 비공표 여론조사 비용이 김한정 씨를 통해 명태균 씨에게 전달된 사실이 인정된다”고 밝혔다.
이어 “명태균 씨 진술 가운데 일부는 그대로 받아들이기 어려운 부분이 있지만, 여론조사 의뢰와 비용 대납 등 핵심 사실관계는 객관적 증거와 다른 증거들에 의해 충분히 인정된다”고 판시했다.
오 시장 측은 재판 과정에서 혐의를 전면 부인하며 무죄를 주장해 왔으며, 이번 판결에 불복해 항소할 것으로 예상된다.
정치자금법상 선출직 공직자는 벌금 100만원 이상의 형이 대법원에서 확정될 경우 직을 상실한다. 이번 판결은 1심으로, 항소심과 대법원 판단을 거쳐 형이 확정돼야 시장직 상실 여부가 최종 결정된다.

The Seoul Central District Court’s Criminal Division 22 (Presiding Judge Cho Hyung-woo) on Tuesday sentenced Seoul Mayor Oh Se-hoon to a 10 million won fine in the first trial on charges of violating the Political Funds Act.
Oh was indicted over allegations that, ahead of the 2021 Seoul mayoral by-election, he received unpublished opinion polls from political broker Myung Tae-kyun, while the survey costs were allegedly paid by his supporter Kim Han-jung on his behalf.
The court found that Oh had requested the opinion polls from Myung and that the survey costs were paid through Kim on his behalf. It also ruled that the payment constituted political funds under the Political Funds Act.
In its ruling, the court stated that “Oh Se-hoon met Myung Tae-kyun in December 2020, was introduced to an election polling expert, and had sufficient motive to request opinion polls from Myung.” It added that “the unpublished polls were conducted at Oh’s request, and the costs for the surveys carried out by Mirae Hanguk were delivered to Myung Tae-kyun through Kim Han-jung.”
The court further said that while some parts of Myung’s testimony were not entirely credible, the core facts—including the request for the opinion polls and the third-party payment of survey costs—were sufficiently established through objective evidence and other supporting testimony.
Throughout the trial, Oh denied all allegations and maintained his innocence. He is expected to appeal the ruling.
Under South Korea’s Political Funds Act, an elected public official loses office if a fine of 1 million won or more becomes final through the Supreme Court. As this is a first-instance ruling, Oh’s status as Seoul mayor will be determined only after the appellate and Supreme Court proceedings are completed.
